Welcome to ServiceJan! These Terms and Conditions (the “Terms”) govern your access to and use of the ServiceJan website, applications, marketplace, and related software and services (collectively, the “Services”). By registering, affirmatively accepting these Terms, or otherwise using the Services where legally sufficient to form an agreement, you agree to these Terms. If you do not agree, do not use the Services. Merely appearing in our public directory does not mean a provider has accepted these Terms.
1. Use of the Services
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or use transactional features. You agree to comply with applicable laws and these Terms. If acting for a business, you represent that you are authorized to bind that business.
2. Accounts and Provider Profile Claims
Registered users must provide accurate information, protect account credentials, and notify ServiceJan of unauthorized access. A person claiming a business or provider profile represents that they have authority to do so. ServiceJan may request verification, resolve competing claims, and suspend or reject unverifiable or misleading profiles. Claiming a profile does not guarantee jobs, placement, or earnings.
3. Services, Bookings, and Independent Providers
ServiceJan provides software for managing service operations and a marketplace through which customers may discover and book independent service providers. Unless expressly stated otherwise, ServiceJan does not perform the underlying work and is not the employer or agent of a listed provider. Providers are responsible for their licenses, insurance, qualifications, personnel, estimates, service quality, warranties, taxes, and legal compliance. ServiceJan may assist with scheduling, communications, payments, and disputes, but does not guarantee outcomes.
4. Public Provider Directory and Business Information
ServiceJan may collect, organize, verify, supplement, and display lawfully obtained publicly available business information and provider-submitted information, including business names, public contact details, service categories, locations, and coverage areas, to facilitate customer discovery, AI-assisted search, matching, and marketplace connections. Collection and use remain subject to applicable privacy laws, third-party rights, and our Privacy Policy.
A listing may exist before the provider registers or claims it. An unclaimed listing does not imply consent, affiliation, verification, endorsement, current availability, or agreement to accept bookings or pay commissions. Authorized representatives may request to claim, correct, or remove a listing by contacting ServiceJan; we may verify their authority and handle requests as required by law.
5. Payments and Marketplace Commissions
Customer service amounts, taxes, and applicable fees will be disclosed during the booking or checkout process. Payments may be handled by third-party processors and are subject to applicable processor terms. Users authorize charges that they affirmatively approve.
Marketplace-generated jobs: ServiceJan charges participating providers a 10% marketplace commission on qualifying new customer jobs generated and booked through the ServiceJan Marketplace. The commission is calculated on service amounts actually collected, excluding separately stated taxes, tips, and refunded amounts, unless different terms are expressly disclosed and accepted before the job is accepted. The commission applies only after the provider affirmatively accepts the applicable marketplace terms and qualifying job.
Providers’ own jobs: ServiceJan charges 0% marketplace commission on jobs from providers’ existing customers, independently acquired customers, direct referrals, or other jobs not generated through the ServiceJan Marketplace, including such jobs managed using ServiceJan software. Software subscriptions, payment-processing fees, and separately disclosed fees may still apply.
Qualifying marketplace jobs and applicable commissions will be identified before provider acceptance. Future work with a marketplace-referred customer will not automatically incur commission unless separate repeat-booking terms are expressly disclosed and accepted. Providers may contact ServiceJan to dispute job attribution or commission calculations. Providers must not deliberately misclassify an accepted qualifying marketplace transaction to evade an agreed commission.
6. Cancellations, Refunds, and Disputes
Cancellation and refund terms may depend on the service provider and the disclosed booking conditions, subject to applicable consumer-protection law. Refunds, chargebacks, and adjustments may affect marketplace commissions on amounts refunded. ServiceJan may facilitate dispute resolution, but nothing in these Terms eliminates rights or remedies that applicable law makes nonwaivable.
7. Prohibited Activities
Users must not commit fraud or unlawful acts; impersonate others; submit inaccurate credentials or unauthorized provider claims; abuse customer information; interfere with security, platform availability, or other users; or reverse-engineer or copy software except as expressly permitted by law. Providers may not misuse customer data obtained through marketplace bookings.
8. Intellectual Property and User Content
ServiceJan and its licensors retain rights to their trademarks, branding, software, and proprietary materials. Providers retain ownership of content they lawfully submit and grant ServiceJan a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and use that content as reasonably needed to operate and promote the Services and provider listings. Providers represent that they have rights to submit such content. This provision does not confer ownership of independently owned third-party content or permit otherwise unlawful use.
9. Reviews, Listings, and Platform Information
ServiceJan may display service descriptions, provider information, customer feedback, and performance indicators. Reviews and rankings may be moderated under published standards. Information may be inaccurate, outdated, or incomplete; users should independently verify qualifications, prices, insurance, and suitability as appropriate. No listing or rating constitutes a ServiceJan guarantee.
10. Disclaimer
To the extent permitted by applicable law, the Services are offered “as is” and “as available,” without guarantees of uninterrupted access, bookings, revenue, accuracy, or results. Nothing herein excludes warranties or consumer rights that cannot lawfully be disclaimed.
11. Limitation of Liability
To the maximum extent permitted by applicable law, ServiceJan will not be liable for indirect, special, incidental, consequential, or punitive damages arising from use of the Services. To the extent permitted by law, ServiceJan’s aggregate liability arising from a claim will not exceed the amounts paid directly to ServiceJan by the claimant for the Services giving rise to the claim during the 12 months before the claim. This limitation does not apply where prohibited by law or to liability that cannot lawfully be limited.
12. Suspension and Termination
ServiceJan may suspend or terminate accounts or marketplace participation for violations, fraud, safety risks, unauthorized profile claims, or other legitimate operational or legal reasons, subject to applicable law. Users may stop using the Services and request account closure, subject to outstanding transactions, applicable retention requirements, and separate subscription terms.
13. Privacy and Communications
ServiceJan handles personal information as described in its Privacy Policy. Where required, marketing communications require appropriate consent and include applicable opt-out mechanisms. Transactional notices may be sent in connection with accounts, bookings, or payments as permitted by law.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to applicable law, disputes relating to these Terms may be brought in the state or federal courts of New York, and the parties consent to jurisdiction there. Mandatory consumer protections and legally required venues remain unaffected.
15. Changes to Terms
ServiceJan may update these Terms and will post the updated version with a revised Last Updated date. We will provide additional notice or obtain affirmative acceptance when required by law, including for material changes to provider fees. Changes do not retroactively increase commissions on previously accepted jobs without applicable consent.
